Issue notice to the non-applicant/State.

Learned Additional Public Prosecutor waives service of notice on behalf of the State.

Two weeks time is granted for filing reply.

In view of the nature of the crime alleged to have been committed by the accused, the prayer for ad-interim anticipatory bail can be considered. However, the accused shall cooperate the police. The police would be required to effect recovery of the knife used in the crime. It is made clear that even after grant of ad-interim protection, the period during which the applicant attends the police station, shall be treated as deemed custody for the purpose of Section 27 of the Indian Evidence Act. Hence, the following order :

i] By way of ad-interim protection, it is directed that in the event of arrest of applicant - Gopal Manoj Ingole, in crime No. 573/2024 registered with Police Station, Malegaon, Dist. Washim, for the offences punishable under Sections 115(2) and 118(1) of the Bhartiya Nyaya Sanhita, 2023, he be released on bail on his furnishing PR bond in the sum of Rs.20,000/- with one surety in the like amount.

ii] The applicant shall not, in any way, tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend Police Station, Malegaon, Dist. Washim, every day till the next date between 10.00 am and 2.00 pm.

v] The applicant shall cooperate the investigating officer.

vi] The ad-interim protection shall remain in force till the next date.
