This is an Application for anticipatory bail. 2.

The Applicants are apprehending their arrest in Crime No.473 of 2024 registered with Boisar Police Station for the offences punishable under Sections 85, 108, 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

The deceased was the daughter in law of the present Applicants. The deceased was married to the son of the present Applicants on 04th March 2024. According to the prosecution, the present Applicants and the husband of the deceased were harassing the deceased by taunting her about the substandard quality articles gifted by her parents. It is further alleged that the present Applicants and the husband of the deceased used to harass the deceased for dowry. It is alleged that due to the said

2 908-ABA 20-25.doc harassment, on 07th August 2024 the deceased committed suicide by hanging herself.

I have heard Learned Counsel for the Applicants, Learned APP for Respondent No.1-State and Learned Counsel for Respondent No.2. 5.

Learned Counsel for the Applicants submits that the deceased and her husband were residing separately from the present Applicants. It is submitted that after the alleged incident, initially ADR was registered and on 09th August 2024, the statement of the first informant was recorded. It is submitted that in the said statement, the first informant has not made any allegations of harassment against the Applicants. It is submitted that there is no need of custodial interrogation and the Applicants are ready and willing to cooperate in the investigation. 6.

On the other hand, Learned APP for Respondent No.1-State and Learned Counsel for Respondent No.2 submit that there are specific allegations against the present Applicants in relation to the harassment. It is submitted that the deceased died within a period of five months of marriage. It is submitted that considering the nature of crime, the Applicants may not be released on anticipatory bail. 7.

It appears that after the alleged incident initially ADR was registered and on 09th August 2024 the Investigating Officer recorded the statement of the first informant. It appears that in the said statement, the first informant has not made any allegation of harassment against the

3 908-ABA 20-25.doc Applicants. There appears to be a delay in lodging the FIR. Considering the overall facts and circumstances of the case, I am inclined to release the Applicants on anticipatory bail. Hence, the following order:-

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicants in Crime No.473 of 2024 registered with Boisar Police Station for the offences punishable under Sections 85, 108, 3(5) of the Bharatiya Nyaya Sanhita, 2023, they shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with one or two sureties in the like amount.

iii. The Applicants shall attend the concerned Police Station as and when called for by the investigating officer and shall cooperate in the investigation. 8.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
