Heard the learned advocates for the parties.

The applicant, who is the accused in Crime No.419/2024, registered with Police Station, Ural, District Akola, has made this application for pre-arrest bail. The crime has been registered for the offences punishable under Sections 354-A, 354-D, 506 and 354 of the Indian Penal Code, 1860 (for short, "IPC").

Learned APP would submit that, in terms of the observation made by this Court on the last date, Section 41-A of the Code of Criminal Procedure, 1973 notice was issued to the accused. The accused appeared before the Police Officer. Learned APP would further submit that the accused has extended co-operation to the Investigating Officer. 4.

The crime registered against the applicant is under Sections 354-A, 354-D, 506 and 354 of the IPC. The accused is

-2- 25.ABA.25.2025.odt extending co-operation. Considering the nature of the allegations against the accused, his custodial interrogation may not be necessary. It is further seen that the victim, on the date of the offence, was 22 years old. The accused had threatened her to spoil her life. He would ensure that the victim does not get married. Initially, the crime was not registered. The informant was constrained to make an application under Section 156(3) of the Cr.PC. The learned Magistrate was pleased to direct the Investigating Officer to register the crime and file the chargesheet within 60 days from 11th December, 2024. 5.

In view of the above, I do not see any reason to reject the application. The apprehension put-forth by the learned APP can be taken care of by imposing appropriate conditions. Hence, the following order:

ORDER

i] The application is allowed.

ii] In the event of arrest of the applicant/accused - Aniket S/o. Dyandeo Fandat in connection with Crime No.419/2024, registered with Police Station Ural, District Akola for the offences punishable under Sections 354-A, 354-D, 506 and 354 of the IPC, he be released on bail on his furnishing P.R. bond in the sum of Rs.20,000/- (Rs. Twenty Thousand) with one surety in the like amount. iii] The applicant shall not, in any way, tamper with the prosecution evidence.

-3- 25.ABA.25.2025.odt iv] The applicant shall not pressurize or threaten the prosecution witnesses.

v] The applicant shall attend the Police Station, Ural, District Akola everyday between 7:00 p.m. and 9:00 p.m., till filing of the charge-sheet.

vi] The applicant shall co-operate the Investigating Officer.

vii] The application stands disposed of in the above terms.
