This is an application for anticipatory bail. 2.

The applicants are apprehending their arrest in Crime No.221 of 2024 registered at Pangari Police Station, Solapur for the offences punishable under Sections 352, 351(2), 3(5), 118(1), 115(2) of the Bharatiya Nyaya Sanhita, 2023 (BNS). 3.

On the date of incident which took place on 04.12.2024, on account of some trivial issues dispute arose between the complainant and the present applicants. It is alleged that during the said dispute the present applicants had assaulted the complainant and his family members by iron tommy, sticks, fist and kick blows and caused them grievous hurt. 4.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. Dinesh S. Sherla 1/2

There is cross FIR in relation to the incident in question. Prima facie, the incident does not appear to be premeditated. 6.

The learned counsel for the applicants, on instructions, states that the applicants are ready to stay away from the village Ukkadgaon, Tal. Barshi, Dist. Solapur.

Considering the overall facts and circumstances of the case and as there are no other criminal antecedents against the applicants, I am inclined to release them on anticipatory bail. In the result the following order is passed.

ORDER

A) The Anticipatory Bail Application is allowed. B) In the event of arrest of the applicants in C.R. No. 221 of 2024 registered at Pangari Police Station, Solapur for the offences punishable under Sections 352, 351(2), 3(5), 118(1), 115(2) of the BNS, they be released on bail on executing P.R. Bond in the sum of Rs.25,000/- each with one surety or two sureties in the like amount.

C) The applicants shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.

D) The applicants shall not enter into the limits of village Ukkadgaon, Tal. Barshi, Dist. Solapur for a period of one year. [N.R.BORKAR, J.] Dinesh S. Sherla 2/2
