This is an application for anticipatory bail. 2.
The applicant is apprehending his arrest in Crime No.134 of 2024 registered at Devrukh Police Station, Ratnagiri for the offence punishable under Section 87 of Bhartiya Nyaya Sanhita, 2023.

The allegations against the applicant that he abducted the victim with a view to compel her to marry him and even subjected her to sexual intercourse.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The applicant is working as Talathi. The perusal of the statement of the victim shows that she was taking guidance from the applicant for Competitive Examinations. The applicant proposed her for marriage. Initially she refused as they were belonging to different religion, however, later on she accepted his proposal.

The learned counsel for the applicant has placed on record the notice given by the victim and the present applicant to the Marriage Registrar under Special Marriage Act. This makes the prosecution case doubtful.

Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail.
ORDER
(i) Anticipatory Bail Application is allowed;
(ii) In the event of arrest of the applicant in connection with Crime No.134 of 2024 registered at Devrukh Police Station, Ratnagiri for the offence punishable under Section 87 of Bhartiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall attend the concerned Police Station as and when called and shall co-operate with the Investigation.
(iv) Anticipatory Bail Application stands disposed of accordingly.
