The learned counsel for the applicant seeks leave to implead the complainant as party Respondent to the present application. Necessary amendment shall be carried out forthwith.

Issue notice to respondents, returnable on 10th February, 2025.

In addition to Court notice, the Investigating Officer shall intimate about filing of the present application and the next date to the Complainant-Respondent.

The dispute between the parties is in relation to sale and purchase of flats. The learned counsel for the applicant submits that the project in question is still going on. It is submitted that on completion of project, the applicant and other co-accused are willing to hand over the possession of flats to the complainant.

In that view of the matter, till next date, the applicant shall not be arrested.

In the meantime, the applicant shall attend the concerned Police Station on 21st January, 2025 at 11:00 a.m. and shall co-operate with the investigation.
