Heard Mr. Parmar, learned Counsel appearing for the Applicant and Ms. Yadav, learned APP for the Respondent-State of Maharashtra.

By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.832 of 2024 registered with the Shikrapur Police Station, Pune Rural, for the offences punishable under Sections 118(1), 140(3), 3(5), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, the First Informant was forcibly put into a white coloured Swift car and taken to some location, where the First Informant was assaulted with a wooden stick 4.

It is the submission of Mr. Parmar, learned Counsel for the Applicant that a learned Single Judge has protected the Applicant by Order dated 15th January 2025 and the said protection continues till date. He submits that the Charge-sheet is already filed.

On the other hand, Ms. Yadav, learned APP, strongly opposes the Anticipatory Bail Application. She submits that there are a total of 4 Accused. 3 Accused have been arrested and granted regular bail. She submits that the Charge-sheet is filed only against them. 6.

The Charge-sheet is filed against other Accused and therefore investigation is completed. The injuries are of simple in nature.

As there are two antecedents, a learned Single Judge in the Order dated 15th January 2025, has recorded that the Applicant shall stay outside the Pune district till the conclusion of the trial. 8.

Mr. Parmar, learned Counsel for the Applicant, on instructions, states that the Applicant will stay outside the Pune district till the conclusion of the trial and will stay at his relative's residence - Kanif Popalghat, House No.304, Taluka - Parner, District - Ahilyanagar, 9.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Vishal Balasaheb Shivale, in connection with CR No.832 of 2024 registered with the Shikrapur Police Station, Pune Rural, be released on bail on his furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall not enter the Pune district, till

conclusion of the trial, except for attending the Police Station and for attending trial.

(c) The Applicant shall attend the MIDC Police Station, District-Ahilyanagar, once in 15 days i.e. the first and the third Sunday between 11:00 am to 02:00 pm and shall cooperate with the investigation.

(d) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(e) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(f) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(g) The Applicant shall not leave India without prior permission of the Court.
