Heard Mr. Teckchandani, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent - State of Maharashtra. 2.

This is an Application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Anticipatory Bail in connection with Crime No. I - 901 of 2024 registered with Central Police Station.

The First Information Report is appended at page No.16 of the Application. Applicant is arraigned as Accused No.4. Accused Nos.1 to 3 are already released on bail by Magistrate Court. The role of Applicant before me as can be seen from record of the case and statements which are recorded are only to the extent of he been a recipient of Rs.30,000/- by Gpay from Accused No.1.

Prima facie, it is seen that Accused No.1 is alleged to be involved in theft of Rs.2,00,000/- cash and some documents like Aadhar Card, PAN Card, etc. An amount of Rs.1,00,000/- has already been recovered by Investigating Officer from Accused Nos.1 and 2. The role of the present Applicant before me of having received amount of Rs.30,000/- through Gpay cannot be directly related to the commission of the act in question by Accused No.1. In that view of the matter, an arguable case has been made out by Mr. Teckchandani for grant of Anticipatory Bail. The Anticipatory Bail Application is allowed in terms of prayer clause (a), however subject to the following terms and conditions:- (i) In the event of the arrest, Applicant be enlarged on bail on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(ii) Applicant shall report to the Investigating Officer at concerned Police Station, as and when called for by the Investigating Officer for investigation; (iii) Applicant shall furnish particulars of his address and mobile number to the Investigating Officer within one week from today;

(iv) Applicant shall not misuse his liberty in any

manner or influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence; and (v) It is directed that Applicant shall extend complete cooperation in the investigation of the instant case.
