DATE : 12th FEBRUARY, 2025 P.C. :- This application is filed for pre-arrest bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with FIR No. 0490 registered with Vita Police Station, Sangli for the offence punishable under Sections 34, 376 and 506 of the Indian Penal Code, 1860.

This anticipatory bail application is filed by the mother-in-

2/4 law and the husband of the victim. The victim is the informant. 3.

The present proceedings are mainly pertaining to the offences punishable under Sections 376, 506 read with 34 of the Indian Penal Code, 1860. With regard to Section 376 is concerned, the allegation is against the brother-in-law (Rohan Dattatray Jadhav) who is the applicant in Anticipatory Bail Application No. 96 of 2025.

Interim protection was granted to the present applicants by this Court by its order dated 13th January, 2025. However, though this Court had directed that the notice to be issued to the respondents by its order dated 13th January, 2025, since the advocate for the applicants did not supply spare copy to the Registry for issuance of the notice to the respondent no.2/victim, by an order dated 3rd February, 2025, the interim order was vacated.

5. The charge-sheet has been already filed in the present

3/4 proceedings against all accused.

Since there is no much opposition from the learned A.P.P. as regards this anticipatory bail application filed by the mother-inlaw and husband, this anticipatory bail application is allowed with following terms :- (a) In the event of arrest of the applicants in connection with FIR No. 0490 registered with Vita Police Station, Sangli for the offence punishable under Sections 34, 376 and 506 of the Indian Penal Code, 1860, the applicants shall be released on bail till disposal of the trial on furnishing P.R. bond to the extent of Rs.30,000/- each with one or more sureties of the like amount.

(b) The applicants will attend the concerned police station on 17th February 2025 and 18th February 2025, between 11:00 a.m. to 1:00 p.m.

4/4 (c) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade them from disclosing the facts to Courts or any Police Officer and should not tamper with evidence.

(d) The applicants shall furnish their contact numbers and residential address to the Investigating Officer and shall keep him updated, in case there is any change.
