Heard Ms. Shetty, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent - State of Maharashtra. 2.

This is an Application under Section 438 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Anticipatory Bail in connection with C.R. No.1252 of 2024 registered with Mumbra Police Station.

When this matter was opened by Ms. Shetty, learned Advocate for Applicant, Mr. Dedhia, learned APP for Respondent - the State of Maharashtra has drawn my attention to the order dated 24.06.2024 and would persuade me to consider the said order. He would submit that first Anticipatory Bail Application No.1675 of 2024 was heard by this Court (Coram : R. N. Laddha, J.) who was not inclined to grant Anticipatory Bail and thereafter on instructions, the

903.ABA.98.2025.doc said Application was withdrawn. He would submit that though leave was granted to Applicant, considering that previous Anticipatory Bail Application stood dismissed as withdrawn, the present Application should also be placed before the same Court (Coram : R. N. Laddha, J.).

On reading the notice dated 08.02.2024, I am unable to comprehend but since the objection is taken by Mr. Dedhia, learned APP appearing for Respondent - the State of Maharashtra, Registry shall immediately examine the issue and make a report to the Court. 5.

If the present (second) Anticipatory Bail Application is to be heard by this Court, it shall be placed before this Court on 17th January, 2025 alongwith report of Registry, if not, the same may be placed before appropriate Court.
