Apprehending the arrest at the hands of Police in connection with Crime No.5/2025, registered with Police Station Civil Lines, Akola, for the offence punishable under Sections 118(1), 115(2), 3(5) of the Indian Penal Code the applicant approached to this Court for grant of pre-arrest bail.

Heard learned counsel for the applicant, who submitted that the only role attributed to the present applicant is to the extent of assault by fist and kick blows. As far as the custodial interrogation is concerned the applicant has co-operated with the Investigating Agency. Nothing is to be recovered from the present applicant. In view of that, interim protection granted to him deserves to be confirmed.

Learned A.P.P. strongly opposed the said application on the ground that considering the involvement of the present applicant custodial

43-aba100.25.odt 2/2 interrogation is required. In view of that, the prayer for grant of anticipatory bail deserves to be rejected. 4.

On perusal of the recitals of the F.I.R. it reveals that in a sudden fight sudden quarrel the involvement of the present applicant reveals only to the extent that assault by fist and kick blows. Considering the role attributed to the present applicant and considering the fact that he has already co-operated with the Investigating Agency, the interim protection granted to him deserves to be confirmed. Accordingly, I proceed to pass following order :

O R D E R

(i) The ad-interim protection granted to the present applicant by order dated 20.2.2025 is hereby confirmed, subject to the condition that the applicant shall attend the concerned Police Station once in a week on Wednesday between 10.00 a.m. to 1.00 p.m. and shall co-operate with the Investigating Agency. (ii) The applicant shall not induce, threat or promise any witnesses, who are acquainted with the facts of the case.

The application is disposed of.
