With the able assistance of learned APP I have perused the FIR. It is discernible that Applicant initially had a transaction of purchase of 10 mobile phones with the complainant. Complainant paid the amount of Rs. 5,90,000/- but the applicant did not give mobile phones to him. Thereafter, curiously the FIR proceeds further and states that after four months the applicant has given Rs. 49,07,534/- on 14th August, 2023 and Rs. 5,00,000/- on 16th August, 2023 by transferring the said amount in the account of the Applicant. Transaction in question is not understood prima facie as stated in the FIR and the Application also.

Since the Advocate for the Applicant is not present today, last opportunity is given to the Advocate for the Applicant to remain present. If the Advocate for the Applicant does not remain present on the next adjourned date, the Application shall be dismissed. 5.
