This is an application for anticipatory bail. 2.
The applicant is apprehending his arrest in Crime No.1026 of 2024 registered at Yavat Police Station, Pune for the offences punishable under Sections 109, 61(2), 281, 125(a), 125(b), 324(4) of Bhartiya Nyaya Sanhita, 2023 and 134, 184 and 177 of Motor Vehicle Act, 1998. 3.
According to the prosecution, the complainant was having illicit relationship with the wife of the present
applicant. It is alleged that the applicant had thus hatched the conspiracy with the other co-accused in the present crime to kill the complainant. It is alleged that pursuant to the said conspiracy, the car was hired, it's number plate was removed and on the date of alleged incident, which took place on 17.10.2024, the co-accused tried to kill the complainant by giving dash to his motorcycle by the said car. 4.
I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The prosecution has already filed the charge-sheet against the other co-accused. There is absolute no evidence in relation to the alleged motive attributed to the present applicant. The complainant has not handed over any evidence to the investigating officer, in the form of call records or messages between him and the wife of the applicant in support of his version.

Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail.
ORDER
(i) Anticipatory Bail Application is allowed;
(ii) In the event of arrest of the applicant in connection with Crime No.1026 of 2024 registered at Yavat Police Station, Pune for the offences punishable under Sections 109, 61(2), 281, 125(a), 125(b), 324(4) of Bhartiya Nyaya Sanhita, 2023 and 134, 184 and 177 of Motor Vehicle Act, 1998, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall attend the concerned Police Station as and when called by the Investigation Officer and shall co-operate with the Investigation.
(iv) Anticipatory Bail Application stands disposed of accordingly.
