DATE : 18th FEBRUARY, 2025 P.C. :- The present application is filed by the accused no.10 who was the director from 2009 to 2022 in Shivshankar Urban Cooperative Credit Society Limited. 2.

Mr. Patil, learned counsel for the applicant submits that though the present applicant was a director, however, he was not involved into the day-to-day affairs of the credit society. He submits that the the present applicant is suffering various

2/3 ailment. He submits that Mr.Milind Ramchandra Lakhpati, another director of the financial institute has been granted bail by this Court. So also, two more female directors are also granted bail by this Court. Therefore, the present applicant is also claiming parity.

The learned A.P.P. opposes this application and submits that as far as Mr.Milind Ramchandra Lakhpati is concerned, this Court by an order dated 24th October, 2024, in paragraph (6) has noted that a deposit worth about Rs.1.48 crores of the applicant is with the credit society and the applicant therein and family members shall not withdraw the said deposit during the pendency of the investigation and further proceedings.

As regards two other directors are concerned, both of them are female and are senior citizens. Hence, therefore application is on different footings and the applicant should not be granted protection.

As regards the present applicant is concerned, he is a director from 2009 to 2022. During the said period the controversial loans were signed by the signing authority. One of the signing authority has died, two are behind bar and one more is granted anticipatory bail application due to his age and his medical condition.

The fraud alleged to have been committed as of today is worth Rs.13 crores. The learned counsel for the applicant submits that he has to take instructions, as regards the applicant desire to deposit any amount to show his bonafides. 7.
