This application is filed by the original accused no.2 for prearrest bail in connection with the First Information Report (FIR) No.866/2024 registered with Barshi City Police Station, District Solapur Rural for the offence punishable under Sections 137(2), 64, 64(2)(m) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 4, 8, 12, 42 of the Protection of Children from Sexual Offences Act, 2012.

It is the case of the prosecution that the present applicant had played a role of accompanying the victim from her house till she is joining the original accused no.1. Thereafter, there is no role stated in
Diksha Rane 902. ABA 231-25.doc the FIR of the present applicant/accused no.2. As regards accused no.1, he has been arrested and is in custody. 3.
Taking into consideration the offences involved in the FIR, notice needs to be issued to respondent no.2. 4.
Issue notice to the respondent no.2, returnable on 18th February 2025. The I.O. would serve the copy of the present proceedings on respondent no.2.

However, taking into consideration role as mentioned of the present applicant, the present applicant needs to be protected till the next date of the hearing.

In the meanwhile, till the next date of the hearing, no coercive steps be taken against the present applicant. 7.
Stand over to 18th February 2025 under the caption "for circulation".
