The learned counsel for the applicant submits that this is a second pre-arrest bail application. He submits that the first bail application filed before this Court was disposed of on 4 May 2023. Thereafter, pre-arrest application was filed before the Sessions Court at Kalyan and the same was withdrawn on 20 December, 2024. Thereafter the present anticipatory bail application has been filed. 2.

Upon a query put by this Court to the learned counsel for the applicant, that by approaching the Sessions Court on the second occasion, the applicant has withdrawn the pre-arrest bail application. Therefore, the anticipatory bail application was not decided on merits and thereafter the present anticipatory bail application has been filed, Harish

918-ABA-256-2025.doc he seeks liberty to withdraw the present anticipatory bail application and approach the Sessions Court.

The learned APP submits that liberty should not be given by this Court as an anticipatory bail application can be filed as many times as the applicant/accused desires.

Anticipatory bail application is disposed off as withdrawn. 5.

This Court has not gone into the merits of the matter, hence all issues on merits are kept open.
