Apprehending the arrest at the hands of Police in connection with Crime No.235/2025, registered with Police Station Frezarpura, Amravati, District Amravati for the offence punishable under Sections 318(4), 336(2) and 344 of the Bharatiya Nyaya Sanhita, 2023, the applicant approached to this Court for grant of pre-arrest bail. 2.
Learned Counsel for the applicant submitted that the allegation against the present applicant that being she is Cashier she has to accept the amount which is collected by the agent and take the entry and deposit the same with the financial institute i.e. patsanstha. The allegation regarding the collection of the amount is against the agent. As far as the present applicant is concerned only allegation that she has not taken entry, she has returned the amount.

He further submitted that considering the allegation, the custodial interrogation of the present applicant is not required. In view of that, she be protected by granting anticipatory bail.

Learned APP strongly opposed the application and invited my attention towards the various statements of the witnesses and the investigation papers. The agent has collected the amount from the persons who are from the poor strata of the society and for deposit handed over it to the present applicant. Present applicant has not taken entries and the bank was closed from April, 2021. Thereafter also she has collected the money. Thus, the intention of the applicant can be gathered from the said circumstances.

On hearing both the sides and on perusal of the investigation papers it reveals that after closure of the said patsanstha i.e. Samyak Nagri Co-operative Society Ltd., Amravati, the present applicant and the other co-accused have collected the amount and used it for their own benefits. Thus, considering the prima facie material against the present applicant, the application deserves to be rejected.
