By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.226 of 2024 registered with the Walchandnagar Police Station, Pune Rural, for the offences punishable under Sections 329, 326, 354, 324, 427, 323, 504, 506, 143, 147, 148 and 149 of the Indian

Penal Code, 1860 and Section 135 of the Maharashtra Police Act, 1951.

The prosecution case is set out in Paragraph No.2 of the Order dated 24th July 2024 passed by the learned Additional Sessions Judge, Baramati, District-Pune, in Criminal Bail Application No.709 of 2024, which reads as under: "2.

It is the case of prosecution that, first informant Vaibhav Bhimrao Kashid lodged his report to the police station alleging that, there is dispute between the applicants/accused and first informant's family on count of their ancestral agricultural field and civil suits are pending in the Court. On 30/05/2024 at about 06.00 p.m. father Bhimrao Kashid informed first informant that, the quarrel in between applicants/accused and Chatrapati Kashid, who is another uncle of first informant is going on and they are abusing to Chatrapati Kashid due to dispute raised in respect of their agricultural field. Therefore, first informant came at the spot and by giving understanding to his cousin Chatrapati Kashid asked him to go house. That time, coaccused Sagar Kashid abused first informant and threatened as not to intervene in the quarrel.

Thereafter, first informant informed the said incident to police patil of his village and then he dialed 112 number for police help. After some time, he saw that, applicants/accused and other co-accused are coming towards his house by holding iron rod, wooden sticks in their hands. When his cousin brother Santosh Kashid was proceeding on his motorcycle from the road, on seeing him, accused persons prevented him and by abusing and threatening broke the head light of his motorcycle and also broke his mobile phone and thereby caused loss.

submitted that, thereafter, all accused persons came nearby the house of first informant, that time accused Samadhan Kashid gave blow of sharp weapon on the head and leg of brother Dnyaneshwar and due to which fracture injury was caused to him. On hearing shout of quarrel, witnesses came on the spot and whey they were intervening the quarrel, applicants/accused and other accused also assaulted them by means of iron rod, wooden sticks and voluntarily caused hurt to them, so also co-accused Sagar Kashid outraged modesty of sister Jyoti and when she was trying to escape, he assaulted her by brick and caused hurt, also accused persons snatched golden mangalsutra of witness Shakuntala Kashid and Ratan Kashid and caused damage. Thereafter, accused persons threatened to kill them and left the place. Therefore, FIR came to be lodged against applicants/accused and other co-accused."

It is the submission of Mr. Bhujbal, learned Counsel for the Applicant that this a case of cross-FIR. There is a dispute between two families with respect to agricultural land. He submits that the Applicant is not involved in the crime and that in any case the Charge-sheet is filed.

Mr. Mangaonkar, learned APP for the Respondent-State, states that there are a total of 12 Accused. Accused Nos.3, 4, 5, 9, 11 and 12 have been granted regular bail, Accused Nos.1, 2 and 7 have been granted anticipatory bail, Accused No.6 is absconding and Accused No.8 is still behind the bar. On instructions, he

submits that the Charge-sheet is already filed and there are no antecedents against the Applicant.

Perusal of the record shows that there are cross-FIRs and there is a dispute between the family of Accused No.1 and the First Informant concerning agriculture land. In any case, the Chargesheet has already been filed. Thus, investigation is completed. 7.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Sourav alias Shubham Hanumant Kamble, in connection with CR No. 226 of 2024 registered with the Walchandnagar Police Station, Pune Rural, he be released on bail on his furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station as and when necessary and shall cooperate with the investigation.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
