This anticipatory bail application has been filed by a Gram Sevak, Village Shirgaon. It is alleged that the applicant has issued birth certificates to many individuals who actually are the citizens of Bangladesh.

The learned A.P.P. submits that in the Minutes of Gram Sabha, certain issues were added because of the present applicant after he receiving the communication from the Office of the Investigation. He submits that all these Minutes are fraudulently prepared by the applicant in order to escape from the offences which are likely to be

Mr. Bhatkar, learned counsel appearing on behalf of the applicant submits that under Section 11 of the Registration of Births and Deaths Act, 1969, every person who orally gives to the Registrar any information required under the Act, the said information should be entered in the register maintained in this behalf. Hence, the applicant has acted as per the provisions of Section 11. 4.

The applicant is hereby directed to file an affidavit disclosing from the year 2012 till now how many such birth certificates he has issued to individuals. He should also state in the said affidavit the assets possessed by him, his wife, his parents and his children from the year 2012 till date and if there are any additions and subtractions to such property be moveble and immoveable, should also be specified. Let such affidavit be filed by 3rd February, 2025. 5.
