This application is filed under Section under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for seeking pre-arrest bail in connection with the First Information Report (FIR) No.409/2024 registered with Visharantwadi Police Station, Pune City, for the offence punishable under Sections 132, 115(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

This Court by an order dated 13/2/2025 granted interim protection to the applicants. By an order dated 18/2/2025, the interim protection granted earlier was continued. So also, the

ABA 295-25.doc complaint made by Suhani Gayadin which forms part of the present anticipatory bail application at page 31 dated 24/11/2024 wherein the name of one person Mr.Altamash Gulab Shaikh was mentioned. It is further mentioned that Mr. Altamash Gulab Shaikh was trying to threaten Suhani Gayadin with dire consequences. 3.

Today, the learned APP submits that the concerned Senior Police Inspector of the Visharantwadi Police Station is present before this Court and the report of the police has been tendered along with the statement of Mr. Altahmash Gulab Shaikh. The said police officer submits that they are satisfied with the statement made by Mr.Altahmash Gulab Shaikh that he will not harm Ms. Suhani Gayadin and her family members. Further the report submits that Mr.Altahmash Gulab Shaikh would not enter into the jurisdiction of the concerned police station wherein the informant and her family members are residing.

The officer assured the Court that they would take all possible actions to ensure the safety of Ms. Suhani Gayadin and her family members. The statement made by the officer is accepted as a statement made to this Court.

In view of the same, taking into consideration the fact that on

Diksha Rane 6. ABA 295-25.doc 13/2/2025, the learned APP has fairly submitted that the police do not require the custody of the applicants, a case is made out to allow the present anticipatory bail application. Hence, the following order.

ORDER

(a) The anticipatory bail application is allowed. (b) In the event of arrest in connection with the FIR No.409/2024 registered with Visharantwadi Police Station, Pune City, the applicants shall be released on bail, on furnishing P.R. bonds to the extent of Rs.15,000/- each with two or more sureties each of the like amount.

(c) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence. (d) The applicants shall furnish details of their residential addresses, contact numbers and email addresses to the Investigating Officer.

(e) The applicants shall attend the concerned police station as and when called by the I.O.
