DATE : 14th FEBRUARY, 2025 P.C. :- This application is filed for pre-arrest bail in connection with FIR No. 1384 dated 23rd October, 2024 registered with Samta Nagar Police Station, Brihanmumbai Shahar for the offence punishable under Sections 406, 420, 465, 468 and 471 of the Indian Penal Code, 1860.

This court by its order dated 10th February, 2025 directed the present applicant to attend the concerned police station. Today it has been informed to me that the applicant attended the concerned police station on 11th February, 2025 and the statement of the present applicant has already been recorded by the police. It is also informed that the applicant has co-operated in that regard.

An affidavit in reply by one Mr.Mayur Vinaykumar Agarwal, the first informant has been filed in the present proceedings. It has been submitted in the said reply that as far as the present applicant is concerned, although the applicant has been shown as beneficiary of certain amount, it appears that he is just a money mule of the co-accused Ms.Bella D'souza. As regards the accused Mr.Kedar Sudhakar Satam and Mr.Ashwin Karwa are concerned, they have been arrested and the charge-sheet has already been filed against them. As regards Ms.Bella D'souza is concerned, it appears that she is arrested in some another offence and is
3/4 behind the bar. The Investigating Officer through the learned A.P.P. submits that as far as the present applicant is concerned, he has co-operated with the police.

According to me, a case is made out to grant anticipatory bail to the present applicant. Hence, the following order :-
ORDER
(a) The anticipatory bail application is allowed. (b) In the event of arrest in connection with FIR No. 1384 dated 23rd October, 2024 registered with Samta Nagar Police Station, Brihanmumbai Shahar for the offence punishable under Sections 406, 420, 465, 468 and 471 of the Indian Penal Code, 1860, the applicant shall be released on bail, on furnishing P.R. bonds to the extent of Rs.30,000/- with one or more sureties of the like amount.
4/4 (c) The applicant shall co-operate with the investigation and attend the Investigating Officer of the concerned Police Station, as and when called. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.
(e) The applicant shall furnish details of his residential addresses, contact numbers and e-mail addresses to the Investigating Officer.
