Apprehending the arrest at the hands of Police in connection with Crime No.392/2025 registered with Police Station Tirora, District Gondia for the offence punishable under Sections 409, 420, 468 and 471 of the Indian Penal Code, the Applicant approached to this Court for grant of pre arrest bail.

As per the allegations levelled against the present Applicant that she has collected the money being serving as a Dak Sevak but she has not deposited the same and thus misappropriated the amount of Rs.1,63,000/-. On the basis of the said report Police have registered the crime against the present Applicant.

Heard learned Counsel for the Applicant, who submitted that the Applicant has already deposited the alleged misappropriated amount i.e. Rs. 2 Lakhs allegedly between 01.01.2024 and 09.09.2024. The Departmental Enquiry is already initiated against the present Applicant. As far as the custodial interrogation is concerned, which was required for the purpose of recovery of the amount, which she has already deposited. In view of that, she be released on anticipatory bail.

Learned APP strongly opposed the said application on the ground that one more offence is registered against the present Applicant and her custodial interrogation is required, and therefore, prayer for grant of anticipatory bail deserves to be rejected.

On hearing both sides and on perusal of the investigation papers, the involvement of the present Applicant revealed, however, considering the fact that she has already deposited the misappropriated amount, and therefore, her custodial interrogation is not required. In view of that, the Application of the present Applicant deserves to be allowed. Accordingly, I proceed to pass the following order:

The Application is allowed.

The ad interim protection granted to the present Applicant by order dated 27.05.2025, is hereby confirmed on the condition that, she shall attend the concerned Police Station once in a week i.e. on every Monday between 10.00 a.m. and 01.00 p.m. and shall cooperate with the investigating agency. iii.
The Applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case either personally or by way of electronic media.
iv.
The Applicant shall not leave the jurisdiction of District Gondia without prior permission of the District Court Gondia.

Pending application/s, if any, shall stand disposed of accordingly.
