By way of present application, the applicant is seeking pre-arrest bail in the Crime No.75 of 2017, dated 29.03.2025, registered with Police Station Ashti, District - Gadchiroli, for the offence punishable under Section 65(f) of the Maharashtra Prohibition Act, 1949. 3.
It is alleged that on 28.03.2025 after receipt of secrete information, the police staff visited nullah near Subhashgram bit of Rammohanpur forest area. After seeing the police staff and panchas, the present applicant and one another accused fled away from the spot where the applicant and co-accused had made all the preparation for distillation of mhowa liquor. The cattle
2 / 3 5.aba385.2025 grazers nearby identified the present applicant/accused and the co-accused. The police seized 1100 liters of mhowa wash from the spot alongwith other articles. 4.
On this allegation, applicant is apprehending arrest in the matter. It is his submission that he was never present on the spot nor he fled away as alleged. However, as there are some cases under Maharashtra Prohibition Act are pending, only on the basis of suspicion his name is included in the alleged offence. Hence, in absence of any proof against applicant he is likely to be arrested in the matter.

Considering the nature of allegations and the offence registered against the present applicant, the applicant has made out a case for grant of ad-interim anticipatory bail. Accordingly, I proceed to pass the following order :
(i) In the event of arrest of the applicant Akhil Sharad Devang in Crime No.75/2017 registered at Police Station Ashti, District - Gadchiroli, for the offence punishable under Section 65(f) of the Maharashtra Prohibition Act, 1949, he shall be released on ad-interim anticipatory bail on his executing P. R. Bond in the sum of Rs.15,000/- with one surety in the like amount.
(ii) The applicant shall attend the concerned police station once in a week i.e. on every Monday
3 / 3 5.aba385.2025 between 10:00 a.m. to 01:00 p.m. and shall cooperate with the investigating agency.
(iii) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court or to any police officer.
(iv) The applicant shall not tamper with the evidence or obstruct the investigation in any manner. (v) The applicant shall co-operate in the investigation by attending the concerned Police Station as and when called by the Investigating Officer on written notice till completion of the investigation.
