The present anticipatory bail application has been filed by the applicant (husband) under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with C.R.No.14/2025 registered with Wagle Estate Police Station for the offences punishable under Sections 85, 115(2), 352, 351(2), (3) of the Bharatiya Nyaya Sanhita, 2023.

By an order dated 27/1/2025, the Sessions Court has categorically recorded that there is no apprehension of arrest save the

Diksha Rane 12 ABA 431-2025.doc case where police take a decision to arrest, the IO would give two days notice before arrest.

The learned APP fairly makes a submission that as of today police do not require the custody of the present applicant. 4.

In view of the same, this anticipatory bail application deserves to be allowed with certain conditions. Hence, the following order.

ORDER

(a) The anticipatory bail application is allowed. (b) In the event of arrest in connection with C.R.No.14/2025 registered with Wagle Estate Police Station, the applicant shall be released on bail, on furnishing P.R. bond to the extent of Rs.30,000/- with one or two sureties of the like amount.

(c) The applicant shall attend the concerned police station on 11/3/2025 and 12/3/2025 between 11.00 a.m. to 1.00 p.m. and thereafter, as an when called for.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.
