The present Anticipatory Bail Application has been filed by the Applicant without they approaching the Sessions Court. The learned APP has raised an objection about the maintainability. 2.

The learned Advocate for the Applicant submits that since there is concurrent jurisdiction, the Anticipatory Bail Application can be entertained by this Court.

The learned APP submits that a notice has been issued under Section 35 (3) of the BNS Act, 2023. If the Applicant is ready to cooperate with the police, the police will record his statement. 4.

The Applicant is directed to cooperate with the Police Authority and attend the concerned Police Station on 17 February 2025, 18 February 2025 and 19 February 2025 between 11.00 a.m. to 1.00 p.m. In case, the Police Authority is of the view that the Applicant should be arrested due to lack of cooperation, they shall issue a notice to the Applicant at least 48 hours in advance. 5.

Hence, this Anticipatory Bail Application is disposed off as not maintainable.
