The Applicant has filed the present Application under 482 of the Bhartiya Nagrik Surakhsa Sanhita, 2023 apprehending his arrest in C. R. No. I-27 of 2025 registered with Chavani Police Station, Malegaon, Dist-Nashik for the offences punishable under Section 420, 323, 504 and 506 r/w 34 of the Indian Penal Code, 1860.

Mr. Bubna, learned counsel for the Applicant /Accused No. 1, submits that at page No. 39, photo copy of the sale deed dated 18 July, 2022 is enclosed. He submits that this is the subject
sale deed in which the Applicant/ Accused No. 1 as a purchaser and the Informant Sanjali Madanlal Jaju as a vendor, have signed and executed the document and the consideration amount is shown as Rs. 27 lakhs. The said amount has been paid by online/RTGS method by the Applicant to the vendor. The possession of the land is with the present Applicant from the date of execution. According to Mr. Bubna, the document has to be valued as per the ready reckoner or as per the value as mentioned in the document for the purpose of paying stamp duty whichever is the higher value will be payable. He submits that as far as the valuation of the document is concerned, the Registrar of Stamp Duty Office has not raised any objection. He submits that the present Applicant/Accused No. 1 has nothing to do with the other accused.

He submits that the offences as mentioned in the Sessions Court order, in paragraph No. 9, all of them are concerned with crime registered against Accused No. 2 to 5. There is no FIR/Crime pending against the present Applicant/ Accused No. 1 except the present one. He further submits that the Applicant is ready to co-operate with the Police and seeks liberty to
add the First Informant As party Respondent No. 2. 4.
Liberty granted as prayed for. Amendment to be carried out forthwith.

The learned APP to serve a copy of the amended Application upon the newly added Respondent No. 2 through the Investigating Officer.

The Applicant is directed to attend the concern police station on 25th February, 2025, 26th February, 2025 and 27th February, 2025 between 11.00 am to 1.00 pm and co-operate with the Investigating Officer by furnishing the document, if any, in his custody as required by the Investigating Officer. 7.
In the meanwhile, till the next date of hearing, no coercive steps be taken against the Applicant. 8.
