DATE : 10th MARCH,2025 P.C. :- This application is filed for pre-arrest bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with FIR No. 0509 dated 28th November 2024 registered with Koregaon Police Station, Satara for the offences punishable under Sections 406, 420, 504, 506 of the Indian Penal Code, 1860 and Sections 39 and 45 of the Maharashtra Money Lending (Regulation) Act, 2014.

Against the applicant, the allegations have been made in the complaint explaining the role which forms a part of the FIR. 3.

On the last occasion i.e. on 17th February, 2025 it was submitted that the present applicant and the informant are in the business of plotting of land and selling them. The issue between the applicant and the informant is purely business transaction and the applicant is ready to co-operate with the investigation. The applicant was directed to attend the police station on 24th February 2025, 25th February 2025 and 26th February 2025.

Today, the learned A.P.P. submits that the Investigating Officer is present in Court and the applicant has complied with the directions given by this Court. She further submits that the applicant has cooperated with the Investigating Officer for recording the statement and the custody of the applicant is not necessary as of now. 5.

Taking into consideration that the parties are dealing with the business of development plot, dispute arose between them pursuant to which FIR has been lodged. However, the applicant has

3/4 co-operated with the police. In such a situation, according to me it is purely a civil dispute. A case is made out by the applicant to allow this anticipatory bail application. Hence, the following order :-

ORDER

(a) The anticipatory bail application is allowed. (b) In the event of arrest in connection with FIR No. 0509 dated 28th November 2024 registered with Koregaon Police Station, Satara for the offences punishable under Sections 406, 420, 504, 506 of the Indian Penal Code, 1860 and Sections 39 and 45 of the Maharashtra Money Lending (Regulation) Act, 2014, the applicant shall be released on bail, on furnishing P.R. bonds to the extent of Rs.30,000/- with two or more sureties of the like amount. (c) The applicant shall co-operate with the investigation and attend the Investigating Officer of the concerned Police Station, as and when called. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person

4/4 acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

(e) The applicant shall furnish details of his residential addresses, contact numbers and e-mail addresses to the Investigating Officer.
