DATED : 10.07.2025 Apprehending the arrest at the hands of police in connection with Crime No.341/2025 registered with Police Station Pusad City, District Yavatmal, for the offence punishable under Section 318(4) of the Bhartiya Nyay Sanhita (BNS) Act, 2023, the applicant approached to this Court for grant of pre arrest bail.

Heard learned Counsel for applicant who submitted that there was an agreement to sale the land and out of that transaction, the consideration amount was also paid and out of consideration amount Rs.6,00,000/- paid. Subsequently, the sale deed was executed in favour of another persons and, therefore, this FIR came to be lodged. In fact, the entire allegation is of a civil nature. As far as the custodial interrogation is concerned, which is not required. In view of that, he be protected by granting ad-interim protection.

Learned APP strongly opposed the said application and submitted the informant has to recover the amount of Rs.2,00,000/- from the present applicant and the other co-accused, moreover he was duped by obtaining the consideration amount. In view of that the prayer for grant of ad-interim protection deserves to be rejected.

On hearing both the sides and on perusal of the recitals of the FIR and the agreement to sale, it reveals that the dispute between the parties is of a civil nature. Immediate custodial interrogation of the present applicant is not required. In view of that the applicant can be protected by granting ad-interim protection. Accordingly, I proceed to pass the following order.

ORDER

(i) In the event of the arrest in connection with Crime No.341/2025 registered with Police Station Pusad City, District Yavatmal, for the offence punishable under Section 318(4) of the Bhartiya Nyay Sanhita (BNS) Act, 2023, the applicant shall be released on ad-interim anticipatory bail on executing P.R. Bond of Rs.25,000/-, with one solvent surety of like amount.

(ii) The applicant shall attend the concerned Police Station once in a week i.e. on every Monday between 10.00 a.m. to 1.00 p.m. and shall cooperate with the investigating agency.

3 911 aba 507-2025 (ii) The applicant shall not induce threat or promise any witnesses who are acquainted with the facts of the present case.

Stand over after two weeks.
