The applicant is apprehending arrest in Crime No.341/2025 for the offence punishable under Section 318(4) of the Bhartiya Nyaya Sanhita, 2023.

It is alleged that there was an agreement to sell land and for said transaction an amount of Rs.6,00,000/- was paid. Subsequently, the sale was executed in favour of another person and, therefore, the offence is registered.

The applicant is a middle person. The allegations are made that Rs.4,00,000/- are received by the applicant and he had issued cheques which were dishonourd and, therefore, proceeding under Section 138 of the N.I. Act is initiated and during the pendency of said proceedings, this crime is registered.

The learned Advocate for the applicant has stated that the applicant has deposited the amount of Rs.4,00,000/- before this Court during the pendency of this application.

Learned A.P.P. opposed the application stating that though the applicant has deposited the amount, he has played role while executing the agreement.

While granting ad interim protection, the observations are made by this Court that the allegations are of civil nature and considering the reasons given while granting ad interim protection on 10.7.2025, interim protection is confirmed on same terms and conditions. Application stands disposed of.

CRIMINAL APPLICATION (APPP) NO.2291/2025 7.

Learned Advocate for the complainant has filed this application seeking permission to withdraw the amount which is deposited by the applicant.
