The Applicant is seeking pre-arrest bail in connection with C.R. No.36 of 2025 registered with the Sinhagad Road Police Station, Pune, for the offence punishable under Sections 376, 498A, 504, 506 read with 34 of the Indian Penal Code, 1860. 2.

A learned Single Judge by order dated 8th May 2025 appointed Smt. Shalini Phansalkar-Joshi, Former Judge of this Court as Mediator.

Mr. Vishal Deshmukh, learned Counsel appearing for the Applicant and Mr. Sarthak Diwan, learned Counsel appearing for the Respondent No.2 state that the parties have settled the dispute with the assistance of the learned Mediator. They tendered the Consent Terms dated 11th August 2025 signed by the Applicant and the Respondent No.2 in the presence of the learned Mediator. The Applicant and the Respondent No.2 are personally present before this Court. Both of them state that they have settled the dispute in terms of the Consent Terms and that they have signed the Consent Terms.

Accordingly, the said Consent Terms are taken on record and marked 'X' for identification.

Both Applicant and the Respondent No.2 state that they will appear before the learned Family Court, Pune on 22nd September 2025 when the Divorce Petition filed by the Respondent No.2 is scheduled to be listed and the said proceedings will be converted into the proceedings seeking divorce by mutual consent.

As the parties have settled the dispute and as the dispute is matrimonial where both the parties have agreed to file Petition seeking quashing of F.I.R., case is made out for grant of pre-arrest bail to the Applicant. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Himanshu Shivajirao Shinde in connection with C.R. No.36 of 2025 registered with the Sinhagad Road Police Station, Pune, for the offence punishable under Sections 376, 498A, 504, 506 read with 34 of the Indian Penal Code, 1860, he is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.5,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station as and when called.

Accordingly, the Anticipatory Bail Application is disposed of in above terms.

This Court places on record the appreciation of efforts rendered by the learned Mediator to successfully resolve the dispute.
