The applicant is apprehended of arrest in connection with Crime No.246/2025 registered at Police Station Jalgaon (Jamod), District Buldhana for the offences punishable under Sections 115(2), 118(1), 3(5), 351(2), 352, 118(2) of the Bharatiya Nyaya Sanhita, 2023. 2.
It is alleged that the applicant has assaulted the father of the first informant with wooden stick. The applicant was protected by granting ad interim anticipatory bail 3.
The learned Counsel for the applicant has stated that though the antecedents are there, he is attending the trial. The stick is already recovered and the applicant is cooperating the police machinery. The custodial interrogation of this applicant in this crime is not necessary. Hence, prayed to confirm the interim protection granted by this Court.

The learned A.P.P. opposed the application stating that there are antecedents and the applicant has not attended the trial, therefore, the non-bailable warrant was
2 34.aba.567.25.odt issued against him. The applicant is in habit of assaulting others for simple reason. Hence, prayed to reject the application.

The learned Counsel for the complainant has objected to confirm the anticipatory bail stating that there is fracture to the father of the complainant as the applicant has assaulted him. The applicant is in habit of quarreling with any person. Hence, prayed to reject the application. 6.
Heard the learned Counsel for the respective parties.

The applicant was earlier protected by granting ad interim anticipatory bail. Though the fracture is there, the injured is discharged. The custodial interrogation of this applicant is not required as the stick which is used is already recovered during the investigation. The earlier incident is mentioned by the applicant.

Considering the circumstances, the interim protection granted is confirmed on the same terms and conditions contained in the order granting interim protection.
