Heard the learned counsel appearing for the applicant, learned APP for the State and the learned counsel appearing on behalf of the complainant to assist the prosecution.

The applicant is apprehending his arrest in connection with Crime No. 207/2025 registered with Police Station, Ambazari, Nagpur for the offences punishable under Section 420 of the Indian Penal Code r/w Section 318 of the Bharatiya Nyaya Sanhita, 2023. 3.
The allegation against the applicant is that he entered into an agreement with the complainant for purchase of two plots for a valuable consideration. From time to time, the complainant paid an amount of 28,27,760/- to the applicant, but the applicant failed to execute the sale deed. When the complainant visited the plot site, he came to know that the applicant has sold those plots to some other person.

The FIR shows the agreement between the complainant and the applicant was entered into way back in the year 2014. However, for one or the other reason, it could not be materialized. Therefore, the complaint came to be lodged in 2025. Prima facie, it appears that the dispute is of civil nature. The investigation is completed and the charge-sheet has been filed.

In view of the above and considering the delay in lodging the complaint as well as the fact that the applicant appeared before the police under the dictum of this Court by way of interim directions and cooperated with the investigating agency, a case is made out for continuation of the ad-interim protection granted on 31.07.2025. 7.
Accordingly, the criminal application is allowed. 8.
The interim order passed on 31.07.2025 is hereby confirmed. Since, the charge-sheet has already been filed, the applicant need not attend the concerned police station.

The application stands disposed of in the aforesaid terms.
