This bail application is filed under section 438 of Cr.PC. for grant of anticipatory bail to the applicant for an offence punishable under sections 307, 326, 324,323, 506(2), 143, 144, 147, 148 and 149 of Indian Penal Code, under sections 3 and 25 of Arms Act and under section 37(1) 135 of Maharashtra Police Act registered at Ambernath Police station vide C.R. No. 481/2023.

As per the complaint filed, an FIR has been lodged. The role of the present applicant has been mentioned in the said FIR. 3.

Ms. Wable for respondent no.2-first informant submits that the first informant is present in Court. She has tendered an affidavit of

the first informant dated 2 March 2025. In the said affidavit, the first informant has given his no objection to grant pre-arrest bail to the applicant. The same is taken on record and marked as "X" for identification. She submits that the first informant has no objection if pre-arrest bail is granted to the applicant.

Considering the submissions made by the learned counsel for the first informant, according to me, at this stage, the pre-arrest bail applicant of the applicant needs to be allowed. Hence, I pass the following order.

ORDER

(a) The anticipatory bail application is allowed. (b) In the event of arrest in connection with C.R.No.481/2023 registered with Ambernath Police Station, the applicant shall be released on bail, on furnishing P.R. bond to the extent of Rs.30,000/- with one or two sureties of the like amount.

(c) The applicant shall attend and meet the investigating officer of the concerned police station on Monday's of every week at 11.00 a.m. for a period of three months from today or till the filing of the chargesheet whichever is earlier. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person

acquainted with the facts of the case so as to dissuade him from disclosing the facts to the Court or any Police Officer and shall not tamper with evidence.

(e) The applicant shall furnish details of his residential address, contact number and email address to the Investigating Officer.
