Apprehending the arrest at the hands of Police in connection with Crime No.517/2025 registered with Police Station Panchpaoli, Nagpur City for the offence punishable under Sections 118(1), 304(2), 352, 109, 3(5) of the Bharatiya Nyaya Sanhita, 2023, the Applicant approached to this Court for grant of pre arrest bail.

Heard learned Counsel for the Applicant, who submitted that the crime is registered on the basis of the report lodged by Ravinder Singh Gamdur Singh Bamrah who is the owner of Gamdur Bar. It is further alleged that on 29.06.2025 at around 12.30 at night, one person by name Aryan Sonte alongwith his 4-5 friends went to the Bar of the complainant, demanded the liquor for consumption and on refusal for the same he was assaulted and his golden chain

2 49.ABA.598-2025.odt and other golden ornaments were snatched. On the basis of the said report, Police have registered the crime against the present Applicant.

He submitted that, as far as snatching of the golden ornaments are concerned the false allegation is levelled. The Applicant is implicated falsely. As far as his custodial interrogation is concerned which is not required. The injury sustained by the injured is simple in nature. In view of that, the Applicant be protected by granting anticipatory bail.

Learned APP strongly opposed the said Application and submitted that, the custodial interrogation is required for the purpose of recovery of the said golden chain. The CCTV footage also shows the presence of the present Applicant at the time of incident. In view of that, the Application deserves to be rejected.

On hearing both the sides and on perusal of the investigation papers, as far as the involvement and presence of the present Applicant is concerned which reveals from the investigation papers. However, the injuries sustained by the injured is simple in nature and the allegations as to the snatching of the golden ornaments are concerned, at this stage not substantiated by any material. In view of that, his custodial interrogation is not required, and therefore, the Application deserves to be allowed. Accordingly, I proceed to pass the following order:

O R D E R

i.

The Application is allowed.

ii.

In the event of the arrest, the ApplicantJagdeep Singh Angrej Singh Sandhu in connection with Crime No.517/2025 registered with Police Station Panchpaoli, Nagpur City for the offence punishable under Sections 118(1), 304(2), 352, 109, 3(5) of the Bharatiya Nyaya Sanhita, 2023, be released on anticipatory bail, on executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.

iii.

The Applicant shall attend the concerned Police Station twice in a week i.e. on every Monday and Thursday between 10.00 a.m. to 01.00 p.m. and shall cooperate with the investigating agency. iv.

The Applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case either personally or by way of electronic media.

Pending application/s, if any, shall stand disposed of accordingly.
