DATE : 26th MARCH, 2025 P.C. :- This application is filed for pre-arrest bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No. 521 dated 14th September, 2024 registered with Akluj Police Station, Solapur Rural for the offences punishable under Sections 109, 190, 126(2), 352, 351(2), 351(3) and 324(4) of the Bharatiya Nyaya Sanhita, 2023.

As regards the incident which has occurred, the complaint was lodged with the police pursuant to which the FIR has been lodged. The role of the present applicant has been mentioned therein.

On behalf of the applicant, it is submitted that the charge-sheet has been filed. The present applicant aged 21 years is a student pursuing his Engineering course. There is no antecedent as far as the present applicant is concerned. At the time of the alleged crime was committed, the present applicant was standing and was present at the site but he has not taken part in the crime which was committed. The accused nos. 1 to 3 are arrested and granted regular bail. The applicant is ready to co-operate with the police. The custody of the present applicant is not at all necessary.

The learned A.P.P. submits that the statement of the co-accused Mr.Rohan Jadhav has been recorded on 18th September, 2024. In the said statement, it has been mentioned that the present applicant was standing at the site when the offence was committed. The learned A.P.P. submits that there is no antecedent of the present applicant. 5.
I have heard the learned counsel for both the sides and have gone through the documents on record, including the FIR. 6.
It seems that the present applicant who is student pursuing his Engineering course, was present at the site when the alleged offence occurred. The applicant was merely standing at the site and has not physically hit any of the victims.

Considering the fact that there is no much role of the present applicant, when that unfortunate incident has occurred and the fact that the present applicant is pursuing Engineering course, having no antecedent, according to me a case is made out to allow this anticipatory bail application. Hence, the following order :-
ORDER
(a) The anticipatory bail application is allowed. (b) In the event of arrest in connection with Crime No. 521 dated 14th September, 2024 registered with Akluj Police Station, Solapur Rural for the offences punishable under Sections 109, 190, 126(2), 352, 351(2), 351(3) and 324(4) of the Bharatiya Nyaya Sanhita, 2023, the applicant shall be released on bail, on furnishing P.R. bonds to the extent of Rs.20,000/- with two or more sureties of the like amount.
(c) The applicant shall co-operate with the investigation and attend and meet the Investigating Officer of the concerned Police Station on 4th April
4/4 2025 between 11:00 a.m. to 1:00 p.m. and thereafter as and when called.
(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.
(e) The applicant shall furnish details of his residential addresses, contact numbers and e-mail addresses to the Investigating Officer.
