Mr. Amogh Singh, the learned counsel appearing for the applicant submits that the police of the Khar police station had issued notice dated 6/2/2025 to the applicant, directing therein to attend the concerned police station with necessary papers in view of one complaint by one Mr. Anilkumar Singh. Mr. Singh, the learned counsel for the applicant submits that pursuant to the receipt of that notice, the applicant filed an anticipatory bail application before the Sessions Court. However, the Sessions Court rejected the application of the applicant by an order dated 17/2/2025 on the ground that no FIR has been lodged against the present applicant. The learned

Diksha Rane 925 ABA 650-2025.doc counsel for the applicant further submits that the applicant is ready to co-operate with the police and in case they want to take any coercive steps against the applicant, they have to give the applicant at least a notice of 72 hours.

The learned APP submits that the IO is not present today in the Court. He will take instructions from the IO but as of today taking into consideration the photocopy of the notice which is at page 45 of the present proceeding, he makes a fair statement that if a need arises the police will give at least 72 hours notice to the applicant if any coercive steps have to be taken. The learned APP submits that in the meantime, the applicant shall attend the concerned police station in order to record his statement and shall furnish the documents if any as sought by the concerned police officer. 3.

According to me, suffice would be the purpose if this anticipatory bail application is disposed of with the below mentioned directions:-

ORDER

(a) The applicant shall attend the concerned police station on 11/3/2025 and 12/3/2025, between 11.00 a.m. to 1.00 p.m. in order to record his statement as mentioned by the police in their notice

(b) The applicant shall also furnish the documents as sought by the concerned police office if same are available with the present applicant.

(c) In the meanwhile, no coercive steps be taken against the applicant. In case, the police is of the view that the applicant is not co-operating with the investigation, for that purpose they need custody of the present applicant, they will give at least 72 hours prior written notice to the applicant.

In view of the above, the anticipatory bail application is disposed of.
