Heard Mr. Bhalchandra Shinde, learned Counsel appearing for the Applicant and Ms. Yadav, learned APP for the State. 2.

The Applicant is seeking pre-arrest bail in connection with Crime No. 260 of 2024 registered with Bundgarden Police Station, Pune City, for the offences punishable under Sections 406, 409 and 420 read with Section 34 of the Indian Penal Code, 1860. 3.

As per the prosecution case, the incident took place during the period 31st July 2023 till 21st January 2024. The Informant was the Administrative Officer of Sasoon General Hospital, Pune. Accused Anil Mane, Drawing and Disbursing Officer (DDO), and

Ms. Sulakshana Chabukswar, Cashier were looking after accounts work of the Sasoon Hospital. They have transferred an aggregate amount of Rs.4,18,62,942/- illegally and unauthorisedly in the bank accounts of about 16 Government employees and 8 private persons and mis-appropriated the Government money by committing criminal breach of trust.

It is the submission of Mr. Bhalchandra Shinde, learned Counsel appearing for the Applicant that the Applicant was the Superintendent of Sasoon General Hospital, Pune. He has been given additional charge as D.D.O. since 27th July 2023 onwards. The incident took place between 31st July 2023 till 21st January 2024. Mr. Shinde, learned Counsel submitted that the Applicant is suffering from blood cancer and since as none was available for taking additional charge, it was given to him. Mr. Shinde, submitted that by relying on main accused Sachin Sasar, Senior Clerk and Ms. Sulakshana Chabukswar, Cashier and Pooja Garade, Assistant Cashier, he signed certain documents. He submitted that F.I.R. was lodged on 14th September 2024, however, even before that when he came to know about the illegal activities of Sachin Sasar and other co-Accused, he filed complaint on 28th August

2024 with Deputy Commissioner of Police, Economic Offence Wing, Pune and before that with Sasoon Hospital, Pune on 22nd July 2024. He submits that even as per F.I.R., not a single rupee is deposited in his account. He submitted that he is not involved in the crime and he has completely co-operated with the investigation. The charge-sheet has already been filed. 5.

A learned Single Judge has granted interim protection to the Applicant by Order dated 17th March 2025.

Although, learned APP strongly opposes the Anticipatory Bail Application, however, as the Applicant is not the main Accused and in fact as the Applicant has filed complaint with Economic Offence Wing of Pune on 28th August 2024 i.e. much earlier before the F.I.R. has been lodged on 14th September 2024 and the material on record do not show that the Applicant is the beneficiary of the crime, the case is made out for grant of anticipatory bail. 7.

Accordingly, the Applicant is entitled to pre-arrest bail. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicant- Anil Shivram Mane be enlarged on bail in C.R. No.260 of 2024, registered with Bundgarden Police Station, Pune under Sections 406, 409 and 420 of Indian Penal Code, 1860 on executing P.R. bond of Rs.50,000/- and furnishing one or two sureties in the like amount. (ii) The Applicant shall attend the concerned Police Station as and when necessary by the Investigating Officer.

(iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade

such a person from disclosing the facts to the Court or to any Police personnel.

(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

(vi) The Applicant shall not leave India without prior permission of the Court.

The Anticipatory Bail Application is allowed and disposed of accordingly.
