This application is filed under Section 438 of the Code of Criminal Procedure, 1973 for seeking pre-arrest bail in connection with the First Information Report (FIR) No.704/2024 registered with the Vileparle Police Station, for the offence punishable under Sections 120-B, 406, 419, 420 of the Indian Penal Code, 1860. 2.

By an order dated 2/4/2025, the applicants were directed to attend the office of the IO. In the meanwhile, the applicants were protected from being arrested.

It is submitted before me that the applicants have cooperated

In the FIR, the names of the present applicants have not been mentioned. It is during investigation, the names of the present applicants have been cropped up. In the FIR, the bank details are mentioned but those accounts are not belonging to the present applicants. It has been submitted that the applicants are residents of Bihar. It is submitted before me that the names of the present applicants are also mentioned in the crime wherein the co-accused was an accused in Haryana. In that FIR, the present applicants were also not shown as accused. Only for that reason the present crime which is registered against the co-accused Aditya Maurya and Manjeet Singh. There is no evidence as of now against the present applicants. The FIR has been registered after the period around of one year with the Vile Parle Police Station.

I am satisfied that there is no allegation against the present applicants that the amount involved has been deposited in the account of the present applicants. Therefore, prima facie, I am satisfied that the custody of the present applicants would not be necessary as they are ready to cooperate with the IO. Hence, the following order.

ORDER

(a) The anticipatory bail application is allowed. (b) In the event of arrest in connection with FIR No.704/2024 registered with the Vileparle Police Station, the applicants shall be released on bail, on furnishing P.R. bonds to the extent of Rs.30,000/- each with one or two sureties each of the like amount. (c) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence. (d) The applicants shall furnish details of their residential addresses, contact numbers and email addresses to the Investigating Officer.

(e) The applicants shall attend the concerned police station and meet the IO on 28/4/2025 and 29/4/2025 between 11.00 a.m. to 1.00 p.m. and thereafter, as and when called for. 5.

Needless to say that violation of any of the aforesaid conditions would make the applicants liable to face proceedings for cancellation of this anticipatory bail. It is also clarified that the observations made in this order are limited to the question of grant of anticipatory bail
