It is the case of the applicant that the Scheduled CasteS and Scheduled TribeS (Prevention of Atrocities) Act, 1989 is not attracted in the present crime. Since there is a doubt whether the word allegedly used by one of the accused, will amount to insult or humiliation to any member of the Scheduled Caste. He further submits that even the Sessions Court had a doubt about the said word will fall under the category of an insult and humiliation of the member of the Scheduled Caste. This can be seen in paragraph 6 of the order dated 1/3/2025 passed by the Sessions Court.

The learned counsel for the applicant on instructions submits that without admitting the guilt, the applicant is ready to hand over the wooden stick, which is alleged to be used in the incident, by Tuesday i.e. 11/3/2025 to concerned IO.

Let the matter come up on 17/3/2025 under the caption "for urgent circulation".

In the meantime, no coercive steps be taken against the applicant till next date of the hearing.
