The learned A.P.P. waives service of notice for non-applicant/State.

The applicant has apprehension of arrest in Crime No.312/2025 registered with Police Station Hingana, District Nagpur for the offences punishable under Sections 316(4), 336(3) and 338 of the Bharatiya Nyaya Sanhita, 2023.

The allegations made against this applicant are that the applicant has misappropriated Rs.40,45,200/- from the student's fees. The applicant is a clerk. He has lodged complaint against the Management.

Considering the allegations made against him and as the notice he has received under Section 35 of the B.N.S.S. Act, the case is made out to protect the applicant by granting ad-interim anticipatory bail. Accordingly, I pass following order:
2 22.aba.678.25 i] In the event of the arrest, the applicant - Kapil Moreshwar Mankar, in connection with Crime No.312/2025 registered with Police Station Hingana, District Nagpur for the offences punishable under Sections 316(4), 336(3) and 338 of the Bharatiya Nyaya Sanhita, 2023 be released on ad-interim anticipatory bail, on executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
ii] The applicant shall not in any way tamper with the prosecution evidence.
iii] The applicant shall not pressurize or threaten the prosecution witnesses.
iv] The applicant shall attend the concerned police station twice in a week i.e. on Wednesday and Thursday between 1.00 p.m. to 2.00 p.m.
v] The applicant shall co-operate the investigation officer.
The protection shall remain in force till next date.
