This is an Application filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail in connection with CR No.726 of 2023 registered with the Vadgaon Nimbalkar Police Station, District-Pune, for the offences punishable under Sections 384, 376(2)(n), 354, 354A, 504, 506 and 34 of the Indian Penal Code, 1860 and Section 66E of the Information Technology Act, 2000.

It is the submission of Ms. Madake, learned Counsel appearing for the Applicant that the Applicant is Accused No.2. The Applicant is the mother of Accused No.1 - Mahesh Navnath

Dandawate. It is her submission that most of the allegations in the FIR are against the Accused No.1 and therefore the Applicant be granted relief of anticipatory bail. She submits that Accused No.1 has been arrested and he has been released on regular bail. 3.

On the other hand, Ms. Yadav, learned APP strongly opposes the Anticipatory Bail Application. She submits that although it is correct that the main allegations are against the Accused No.1, however, Accused No.2 i.e. the present Applicant had also played a major role. She submits that the offence is very serious and therefore the Anticipatory Bail Application be dismissed. On instructions, Ms. Yadav, learned APP submits that the Charge-sheet has been filed on 11th December 2023.

Perusal of the record shows that the main allegations are against the Accused No.1 - Mahesh Navnath Dandawate. The present Applicant - Aasha Navnath Dandawate is the Accused No.2 and the mother of Accused No.1. It is true that there are serious allegations against the present Applicant, however, now investigation is completed and the Charge-sheet has been filed on 11th December 2023. Prime Accused i.e. Accused No.1 has been

arrested and thereafter he has been released on regular bail. The Applicant is lady of 55 years.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Aasha Navnath Dandawate, in connection with CR No.726 of 2023 registered with the Vadgaon Nimbalkar Police Station, District-Pune, she be released on bail on her furnishing PR Bond in the sum of Rs.30,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall cooperate with the further investigation, if any.

(c) The Applicant shall furnish her cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person

acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
