Issue notice to the non-applicant, returnable on 01.10.2025.

The learned A.P.P. waives service of notice for non-applicant/State.

The applicant has apprehension of arrest in Crime No.28/2025 registered with Police Station, Kapil Nagar, District Nagpur for the offences punishable under Sections 406, 420, 506(2), 504 read with Section 34 of the Indian Penal Code.

It is the case of the prosecution that the first informant was searching to purchase the plot for constructing house and he got acquainted with one Gaurav Gundane. Said Gaurav Gundane took him to one Omkar Bhaurao Anjikar, thereafter, he got acquainted with one Shankar Maniram Bagde and therefore, he came in contact with the present applicant.

The allegations made against this applicant are that he has pretended that he is the owner of the said plot and the amount was deposited in his account.

The learned Counsel for the applicant has stated that one of the accused is protected by granting anticipatory bail and ad-interim bail is granted to another co-accused.

Considering the allegations made against this applicant and the compromise deed is executed between the complainant and accused No.1, the applicant is protected by granting ad-interim anticipatory bail. Accordingly, I pass the following order:

i] It is directed that in the event of arrest of the applicant in connection with Crime No.28/2025 registered with Police Station, Kapil Nagar, District Nagpur for the offences punishable under Sections 406, 420, 506(2), 504 read with Section 34 of the Indian Penal Code, he be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend the concerned police station on every Monday and Saturday between 1:00 p.m. to 2:00 p.m.

The protection shall remain in force till next date.
