The APP has raised a preliminary objection about the maintainability of the anticipatory bail application as the provisions of Maharashtra Control of Organized Crime Act, 1999 (M.C.O.C. Act) has been invoked. He submits that the Division Bench of this Court in the case of Lata Ratan Rokade vs. State of Maharashtra And Anr., has held that where the provisions of the M.C.O.C. Act has been invoked since under Section 21(3) of the M.C.O.C. Act, an anticipatory bail application would be not maintainable. The parties can approach before the Hon'ble Court under the provisions of Article 226 of the Constitution of India seeking grant of bail or the pre-arrest bail under M.C.O.C. Act.
