The counsel for the applicant submits that the present matter is of Immoral Traffic (Prevention) Act, 1956. He submits that the present applicant is the owner of the premises. As per the applicant, he had given the premises on leave and license basis. Therefore, he has no role to play if the licensee conducts any illegal business in the subject premises.

The learned APP submits that the copy of the present anticipatory bail application has not been served on the State. On instructions from the investigating officer, she submits that the case of the present applicant is that he is the owner of the premises in which according to the investigating officer, an act of prostitution was going on. She submits that the statements of the victims have been recorded. Harish
912-ABA-701-2025.doc The victims appears to be girls from Bangladesh, who were specifically brought into the present hotel for conducting the illegal business of prostitution. She further submits that there are atleast three other criminal antecedents registered against the present application viz. (i) CR 47/2024 U/s.143,147,149,452,506 of IPC, Sec. 135 of B.P. Act (ii) CR 25/2014 U/s. 325,323,504,506 r/w Sec.34 of IPC (iii) CR 117/2018 U/s.353,160,143,147,149,323,427,504,506 of IPC She submits that the investigating officer is in the process of taking steps under Section 18 of the Immoral Traffic (Prevention) Act, 1956 and by next date, they will inform the Court about the progress done in that regard.

The applicant is directed to serve a copy of the present proceeding on the state in the course of the day. 4.
