The applicant is apprehending arrest in Crime No.135/2025 for the offence punishable under Sections 115(2), 118(1), 3(5), 351(3) and 352 of the Bhartiya Nyaya Sanhita.

The quarrel took place between two groups. Toufik Khan wrongfully restrained Riyaz Khan and assaulted him with iron rod on his head and shoulder and when his father Yar Mohammad intervened, he was also beaten. Riyaz Khan assisted in holding Bilal Khan while assault continued and threatened to kill them if they reported the matter. There are eye witnesses, villagers witnessed the incident and thereafter the F.I.R. is registered. 3.

The learned Advocate for the applicant has stated that all the injuries are of simple nature, though the offence under Section 118 of the B.N.S. is registered, considering the nature of injuries and as the charge sheet is filed, custodial interrogation is not necessary. Hence, prayed to confirm the interim protection granted by this Court. 4.

The learned A.P.P. has stated that applicant is protected on 18.9.2025. Now charge sheet is filed and hence, prayed to pass an appropriate order.

As the charge sheet is filed and considering the nature of the injuries which are simple in nature, the order passed on 18.9.2025 is confirmed on same terms and conditions with modification that the applicant shall attend the trial Court on each and every date instead of concerned police station.
