The applicant is apprehending arrest in connection with crime No. 409/2025, registered with Goregaon Police Station, Dist. Gondia (Rural), for the offences punishable under Sections 318(2), 337, 336(3), 234, 3(5) of the Bhartiya Nyaya Sanhita, 2023.

Having heard the learned counsel for the applicants, the learned APP for the State and having gone through the case diary, it appears that the allegations against the present applicants are that they being members of the Gram Panchayat have misused the seal of the Gram Panchayat while issuing No Objection Certificate and forged the signature of the Sarpanch.

The contention is that, the applicants were protected by ad interim order dated 18.9.2025 and as per the

48aba707.2025..odt directions in the order, they have attended the concerned Police Station and also cooperated in the investigation. It is also contended that chargesheet has been filed and therefore, custodial interrogation of the applicants is not required.

Per contra, learned APP has objected the application on the ground that, even prior to this incident, one noncognizible offence came to be registered against the applicants, on similar allegations.

It appears that the applicants were directed to attend the concerned Police Station when they were protected by interim order. Accordingly, they attended and cooperated in the investigation. It further appears that the charge sheet has been filed and nothing is required to be seized from the present applicants. Hence, no custodial interrogation of the applicants is warranted.

Therefore, the order passed by this Court dated 18.9.2025 is hereby confirmed. The applicants shall appear before the Investigating Officer as and when directed. Application is disposed of.
