DATE : 19th MARCH, 2025 P.C. :- By an order dated 12th March, 2025, the complainant/first informant was directed to attend the office of the Investigating Officer (IO) in order to help the IO to identify the people who were seen in the video clip of the incident.

The learned A.P.P. submits that inspite of specific directions, the complainant has chosen not to attend the office of the IO. 3.

Mr.Khan, the learned counsel representing the complainant submits that the complainant did not attend the office of the IO, since

2/3 before the directions could be given by this Court, she already attended the office of the IO. Therefore, according to the complainant, there is no need to attend the office of the IO. 4.

I am of the view that the complainant does not want to attend the office of the IO an adverse inference can be drawn from the same. 5.

This application is filed for pre-arrest bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with FIR No. 0159 dated 12th February, 2025 registered with Santacruz Police Station for the offence punishable under Sections 119(2), 126(2), 189(2), 190, 351(2), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023.

At this stage, Mr.Khan, the learned counsel for the complainant seeks a short accommodation to permit the complainant to attend the office of the IO. As a matter of last chance, the complainant/first informant is directed to attend the office of the IO on 25th March, 2025 between 11:00 a.m. to 1:00 p.m.

The complainant is directed to co-operate with the IO. 8.

Stand over to 1st April, 2025. Matter to come up under the caption of 'Urgent Circulation'.

Taking into consideration the behaviour of the complainant, no

3/3 coercive steps be taken against the applicant till the next date of the hearing. However, the IO can proceed further with the investigation. [RAJESH S. PATIL, J.]
