The learned counsel for the applicant submits that the present matter pertains to the allegation of evasion of customs duty. He submits that the goods have partly been seized at Port and at Yeola i.e. the place where the factory of the applicant is situated. He submits that as far as the goods which were at the Port, the same have been provisionally released, on a bond issued by the applicant's company under Section 110-A of the Customs Act. However, the said goods have not reached till date to the applicant's company and he understands the same is in route.

Issue notice to the respondents, returnable on 1/4/2025. Apart from the Court notice, advocate for the applicant is permitted to serve the respondents by advocate's private notice by all permissible modes of service and file affidavit of service to that effect before the next date of the hearing. The learned APP waives service on behalf of the respondent no.4.

As per the summons issued the applicant is directed to attend the office of the Intelligence Officer, Customs, tomorrow i.e. on 18/3/2025, at 11.30 a.m.

In the meanwhile, the present applicant should not be arrested by the respondents till the next date of the hearing i.e. 1/4/2025. 5.
