DATE : 9th APRIL, 2025 P.C. :- After this matter was argued for some time, both the learned counsel agree that without prejudice to the rights and contentions of both the parties, the applicant will deposit with the Department a sum of Rs.9 crore being the amount calculated by the Department for misdeclaration of the goods worth Rs.54 crores. The said amount of Rs.9 crores will be deposited with the Department without the applicant admitting his guilt.

It is further agreed between the parties on instructions of their

KVM 2/2 2 - ABA 727 OF 2025.doc respective clients that once a sum of Rs. 9 crore is deposited with the Department, the applicant will also move an application for quashing of the present proceedings. So also, Department will consider waiving of the penalty, if any.

Stand over to 22nd April, 2025. Matter to come up under the caption of 'Directions'.

In view of the same, no coercive action be taken against the present applicant.

The said amount will be deposited before the next date of the hearing.
