DATED :- 07.04.2026 The applicant seeks anticipatory bail in connection with Crime No. 121/2025 registered with Police Station Nandanwan, Nagpur for the offence punishable under Section 420 r/w. 34 of the Indian Penal Code.

Heard the learned counsel for the applicant as well as the learned APP for the State assisted by Shri Kariya, learned counsel assisting the prosecution. I have perused the case-diary.

Perusal of the case-diary reveals that complainant- Hemant Patil met the husband of the applicant- Waman Dhambare in the year 2022 through a lady named Kavita Zade. Waman Dhambare told the complainant that he has good connections with the
2 68-aba-754-25.odt officers of the Maharashtra State Power Generation Company Ltd. (for short, "MAHAGENCO") and he can provide a job to him with MAHAGENCO if he pays money. Hence, on 17.10.2022 the complainant gave Rs.5 lakhs in cash to Waman Dhambare at his house in Nagpur for providing a job. From time to time, Waman Dhambare demanded money on the pretext of providing a job. 4.
Therefore, the complainant on 30.03.2022 transferred an amount of Rs. 2 lakhs through NEFT from his account to the account of Vaishali Dambhare, the daughter of Waman Dambare, Rs.2 lakhs and Rs.3 lakhs on 25.04.2022 and 26.08.2022 through NEFT in the account of the present applicant and Rs.1 lakhs to the account of main accused- Waman Dambhare on 17.08.2022. Thus, according to the complainant, he has paid a total amount of Rs.13 lakhs to main accusedWaman Dambhare but he did not provide a job to him and also avoided taking his calls. Later on, he came to know that Waman Dambhare has also taken money from other persons and therefore, he lodged the complaint with the Police. Accordingly, the aforesaid offence came to be registered against the accused persons. 5.
It appears that the promise of providing job to the complainant was made by the husband of the applicant- Waman Dambhare. It also appears from the FIR itself that on the instructions of main accusedWaman Dambhare, the complainant has deposited the
3 68-aba-754-25.odt amount in the account of the present applicant. Thus, the main role of inducement to pay the amount for providing job has been assigned to Waman Dambhare, the husband of the applicant.

There is no allegation in the FIR that it is the applicant who induced the complainant to pay the amount for getting a job with MAHAGENCO. It appears that the bank account of the applicant was used by main accused- Waman Dambhare for taking the amount from the complainant. The applicant is the wife of the main accused- Waman Dambhare and therefore, use of the bank account by the husband of the applicant for his illegal dealings cannot be ruled out. It is also to be noted that the applicant was protected by ad-interim order of this Court. Accordingly, the applicant has appeared before the concerned Police Station and co-operated in the investigation.

Considering the fact that the complainant has deposited the amount in the bank account of the applicant at the instance of main accused- Waman Dambhare as well as the role assigned to the present applicant and the fact that the applicant is a lady; in my view, a case is made out for confirming the ad-interim protection granted to the applicant on 06.10.2025. Hence, the following order:- i) The application is allowed.
4 68-aba-754-25.odt ii) The order dated 06.10.2025 granting adinterim prosecution to the applicant is hereby confirmed on the same terms and conditions.
iii) The applicant shall appear before the concerned Police Station as and when directed by the Investigating Officer.
